Opsess (“Opsess,” “we,” “us,” or “our”) is a trade name of Aidhu LLC, a Wyoming limited liability company. We respect your privacy and are committed to protecting the personal information you share with us. This Privacy Policy explains what we collect, why we collect it, how we use and share it, how long we keep it, and the rights you have over it.
This policy applies to the Opsess website and to any inquiries, communications, or bookings you make with us through it. Please read it in full. If you do not agree with it, please do not use our website or submit information to us.
1. Who we are
For the purposes of applicable data protection law, the data controller is:
Aidhu LLC (operating as Opsess)
30 N Gould St, STE R, Sheridan, WY 82801, USA
Email: hello@opsess.co
Opsess is operated by Aidhu LLC, a Wyoming limited liability company. Where an engagement requires it, we also work from a client’s own location or systems. This means that personal information you provide to us may be accessed and processed in the United States and in other countries where we or our service providers operate, or in another location, depending on the nature of our work. See Section 8 (International data transfers) for details.
2. The information we collect
We only collect personal information when you choose to give it to us, or automatically through standard website technologies described below. We do not require you to provide personal information to browse the public pages of our website.
Information you provide to us:
- Contact and inquiry form. When you contact us or request information, we collect your name, email address, company name, and any details you include in your message.
- Calendar booking. When you book a call with us, we (and our scheduling provider) collect your name, email address, the date and time of your booking, and any information you add when scheduling.
- Newsletter sign-up. If you subscribe to our newsletter or updates, we collect your email address and, if you provide it, your name.
- Correspondence. If you email us or communicate with us, we keep a record of that correspondence.
Information we collect automatically:
- Usage and device data. When you visit our website, our servers and analytics tools may automatically record information such as your IP address, browser type, device type, referring pages, the pages you view, and the dates and times of your visits.
- Cookies and similar technologies. See Section 6 below.
We do not intentionally collect any special categories of personal data (such as health, race, religion, or political views), and we ask that you do not send us such information.
3. How we use your information and our legal bases
We use your personal information to:
- respond to your inquiries and provide the information or services you request;
- schedule, prepare for, and follow up on calls and meetings;
- send you our newsletter or updates, where you have asked to receive them;
- operate, maintain, analyze, and improve our website;
- manage our business relationship with you and meet our contractual and professional obligations;
- protect the security of our website and prevent fraud or misuse; and
- comply with our legal and regulatory obligations.
Where the UK GDPR or EU GDPR applies to you, we rely on the following legal bases for processing:
- Consent: for sending you marketing communications such as our newsletter, and for non-essential cookies. You may withdraw consent at any time.
- Legitimate interests: to respond to inquiries, run and improve our website, and pursue business development, where those interests are not overridden by your rights.
- Performance of a contract / steps prior to a contract: to respond to requests and provide services you have asked for.
- Legal obligation: where we must process information to comply with the law.
4. How we share your information
We do not sell or rent your personal information for money. With your consent, we use third-party analytics and marketing tools on our website, including tools that identify the organization a visit comes from. Some of these providers may also use information about your visit for their own purposes, and some US state laws, including California’s, may treat that as a “sale” or “sharing” of personal information. These tools run only if you accept them, and you can withdraw at any time from Cookie settings in the footer.
We share personal information only in the following circumstances:
- Service providers (processors). We use trusted third-party tools to run our business, and they process personal information on our behalf under contract and only on our instructions. These fall into categories such as a customer relationship management (CRM) platform, a productivity and email suite, a calendar and scheduling provider, one or more website analytics providers, and an email marketing or newsletter provider. The specific tools within these categories may change from time to time as we update our systems. In all cases we share only the minimum information necessary for each provider to perform its function.
- Analytics and marketing providers (with your consent). Providers that measure how our website is used and identify the organization a visit comes from. Some act as independent controllers and process the data under their own privacy policies.
- Professional advisers. We may share information with our accountants, lawyers, or insurers where necessary.
- Legal and safety. We may disclose information where required by law, court order, or regulatory authority, or where necessary to protect our rights, safety, or property, or those of others.
- Business transfers. If our business is reorganized, sold, or merged, personal information may be transferred as part of that transaction, subject to this policy.
5. Social media and third-party platforms
If you interact with us through a social media platform such as LinkedIn, any information you share is also governed by that platform’s own privacy policy. We recommend you review the privacy settings and policies of any platform you use to contact us.
6. Cookies and similar technologies
Cookies are small text files your browser stores for a website. Similar technologies, such as tracking scripts, do the same job without a file. We use as few as we can, and nothing that isn’t essential loads until you say yes.
We use these kinds:
- Essential: needed for the website to work, including remembering your cookie choice.
- Cookie-free visit counting: counts visits, pages viewed and page speed in total. It sets no cookies and doesn’t identify you, so it runs for everyone.
- Analytics (with your consent): shows which pages are read and how, so we can improve the site.
- Marketing (with your consent): identifies the organization a visit comes from, so we can follow up where it’s useful.
When you first visit, a banner asks for your choice and names the tools in each category. You can accept all, reject all, or choose by category, and change your choice at any time from Cookie settings in the footer of every page. Withdrawing consent stops collection from then on; it doesn’t delete what was already collected. To ask about that, email hello@opsess.co.
If you’d rather not be counted by the cookie-free visit counter, you can block it with your browser’s tracking protection or an ad blocker, or email hello@opsess.co. Most browsers also let you refuse or delete cookies; deleting them brings the banner back on your next visit.
7. Data retention
We keep personal information only for as long as necessary for the purposes described in this policy, or for as long as required by law. In practice:
- inquiry and correspondence records are kept for as long as needed to respond and for a reasonable period afterward for business and legal purposes;
- newsletter data is kept until you unsubscribe;
- booking records are kept for as long as needed to manage the relationship.
When information is no longer needed, we delete it or anonymize it.
8. International data transfers
Opsess is operated by Aidhu LLC, a US company, and we use service providers located in various countries. This means your personal information may be transferred to, stored in, and processed in countries outside your own (including the United States and other countries where we or our service providers operate), which may have data protection laws different from those in your country. This includes the analytics and marketing providers you accept in our cookie banner, which may process data in the United States.
For client engagements, personal information may also be stored and processed in a location chosen by the client, including within the client’s own systems or region. Where this applies, the arrangement is governed by the terms of the relevant client agreement.
Where we transfer personal information out of the UK or the European Economic Area, we take steps to ensure it receives an adequate level of protection, such as relying on Standard Contractual Clauses or an equivalent approved transfer mechanism. If you would like more information about our transfer safeguards, contact us at hello@opsess.co.
9. How we protect your information
We use reasonable, industry-standard technical and organizational measures to protect your personal information against loss, misuse, unauthorized access, and alteration. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You provide your personal information to us at your own risk.
To the maximum extent permitted by applicable law, Opsess is not responsible or liable for any loss, damage, or unauthorized access to personal information arising from:
- the acts, omissions, systems, or security failures of third-party service providers, platforms, or networks;
- events beyond our reasonable control, including cyberattacks, hacking, malware, unauthorized interception, or other criminal activity;
- your own failure to keep your devices, accounts, passwords, or credentials secure, or your transmission of information over an insecure connection; or
- personal information stored or processed within a client’s own systems or a location chosen by a client, which remains the responsibility of that client.
Nothing in this policy limits any liability that cannot be excluded or limited under applicable law, including mandatory obligations owed to data subjects under data protection law.
If we become aware of a personal data breach affecting your information, we will act promptly to investigate and, where required by law, notify you and the relevant supervisory authority within the required timeframes. If you believe your interaction with us is no longer secure, please tell us immediately at hello@opsess.co.
10. Your privacy rights
If the UK GDPR or EU GDPR applies to you, you have the right to:
- access the personal information we hold about you;
- request correction of inaccurate or incomplete information;
- request deletion of your information;
- restrict or object to our processing;
- request portability of information you provided to us;
- withdraw consent at any time, where we rely on consent; and
- lodge a complaint with a supervisory authority.
In the UK, the supervisory authority is the Information Commissioner’s Office (ico.org.uk). In the EU, you may contact the data protection authority in your country.
If you are a California resident, you have the right to know what personal information we collect and how we use and share it, to request deletion or correction of your information, and not to be discriminated against for exercising these rights. We do not sell personal information for money. If you accept marketing cookies in our cookie banner, some providers may use information about your visit for their own purposes, which California law may treat as a “sale” or “sharing”. You can decline it in the banner, withdraw at any time from Cookie settings in the footer, or email hello@opsess.co. We do not knowingly sell or share the personal information of anyone under 16.
To exercise any of these rights, email us at hello@opsess.co. We will respond within the time required by applicable law. We may need to verify your identity before acting on your request.
11. Links to other websites
Our website may contain links to other websites. We are not responsible for the privacy practices, content, or accuracy of those websites. Inclusion of a link does not imply our endorsement. If you leave our website to visit a third-party site, you do so at your own risk, and we encourage you to review that site’s privacy policy.
12. Children’s privacy
Our website and services are intended for businesses and professionals. We do not knowingly collect personal information from anyone under the age of 16. If you believe a child has provided us with personal information, please contact us and we will delete it.
13. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. Significant changes will be highlighted where appropriate. We encourage you to review this policy periodically.
